What kind of tree is this?

    my wife found, what appeared to be an acorn, or some kind of pit, in the yard with the beginnings of a tree growing out of it. We would like to know what kind of tree it is. Can someone tell by the leaves?

    I don't know if that's Poison Oak.
    Poison Oak is tri-lobal (three leaves grow from same point)
