What tree is this and is it dying?

Hi, so we have this ornamental tree that I believe is some type of maple. We planted it last fall but curious what is the name of it and from the pictures does it look like it is dying? It is blossoming just a little more than half way up.

It looks like the upper third of your Japanese maple is toast. Root collar disorder and or loss of roots would be my first guess. Expose the root collar, prune out crown dead and maintain proper tree health. It should recover.
