Tree hater threatens to sue!

Hi everyone, nice to be in the house with fellow treeguys. I have a question for ya, a customer of mine called me the other day all upset about an English Walnut on one her rental property that I pruned a few years back. The tenant contacted her and complained about the walnuts. Apparently he wants the tree gone because he is tripping on the walnuts. I didnt realize the landlord could be held liable for something like that but as she says she is. She wanted me to give her price on the tree being removed which I knew she didn't want to get rid of it. I suggested pruning all the walnuts off as an alternative and she went for it.

My question show the hell do you price something like this. Obviously I don't need much equipment, I just have no idea what it would take to do something like this without a bucket. Any ideas? Thank in advance
 
Charge by the hour.

Also, I'd never let my customers be duped into a total leaf removal contract just because they don't like the leaves on the grounds. The same for the walnuts removal jobs, ABM.

It makes sense to remove the tree. Maybe the tenants are elderly, and have a mean streak to junk in their walkway. You never know. Either way, rolling on the marbles falling from a tree is reason enough to request a take down. Knocking out the nut every year is would get to be ridiculous, ABM. I vote take it down.

Are you sure its an English Walnut? The few I have seen in Pa never bore nuts. Might be a black walnut

rake under the tree for walnuts once a week. keep a record. This shows due diligence on the landlords behalf, or a good faith effort to mitigate the hazard. If it ever went to court you would have all the defense you need.
Unless the landlord is wealthy, I was once paid by the hour to remove/scrub lichen from a tree. The owners did not like the look. Money was no object though.
 
contract it out to aerial arborist he can use his lawn mower with a snow plow on it to clean up the nuts :hmm3grin2orange:

The better solution would be to leave the tree and boot the renter out.
 
Isn't there an injectable that prevents nut formation? I think I remember reading something about that.

So if the tenant sued, would that be a nut case!

Remove the tenant or the tree, either way, something has gotta go, I like the tenant idea.

WRONG!!!!!!!!!!! In PA the law states differently, "due diligence" is exactly right! & the fact the days of sueing over trip n falls are not like they use to be........."get rich quick schemes"! As long as a "reasonable" effort was made to safeguard the tenant/neighbor or passerby they would be ok & I would suggest a sign giving warning to the possible hazards associated; regarding these nuts.......

I believe that's why PA is such a friendly state to have a motocross track and ski resorts because of the common sense laws not allowing frivolous BS.
It would be hilarious to post a warning sign about the dangers of nuts on the ground and suggestion of cleaning them up daily before walking through the area. And damn sure get the overdemanding tenant out of there asap. Sounds like they're looking for a way out of the lease anyways.

I know here, tenants assume the responsibility for yard maintenance, does this person mow the lawn? If so, they are also responsible for the walk. And if they don't like the situation, I would strongly suggest to them as a landlord they need to shaddup or start looking for a new place.

I would also post a sign warning of the Nut that lives in the house.......
 
Sherrill sells a tree injection called "sniper" tree has to be injected during it's pollen season, and it aborts seed production. I use them every year for a few customers, but in my area it's mostly acorns from oak trees but it handles most seed dropping trees.

This is news to me; possibly good news. How effective is it, and on what species?
