Depends on where you are and time of year as well, fire season if you get caught with a modified saw after a fire starts you’re liable for all costs.
A ported saw wont start a fire any easier than a stock saw will... and besides, how would they even know if it was ported or not?

If there’s a fire there’s an investigation part of which they take the equipment from the site to check it all over and up to fire code. Buddy was on a site that had a small fire stated ODF came in to put out fire and took his saws that were on the ground that day.
