control new shoots from roots in the lawn

I live in Jacksonville Fl and I have three oak trees in my front yard (not sure if its live oak or water oak). I have just recently moved there and am trying to establish a lawn. The problem is that I think that I have new tree shoots sprouting from the roots, and its almost taking over parts of the yard ( 10 to 15 feet from the base). I have tried to spray them with herbicide only for them to come back. I plan to add some soil to the yard to level it out (throughout the years some soil has washed away exposing or leaving roots close to the surface), will that help? Will adding soil and sod help. Please advise me on how to control the problem.
