I have a Pin oak that I just planted it is about 7ft. tall. The top 1.5 ft. is very spinnly. Will this be all right or should it be removed.
 
If it's alive, do not cut it. The tree would respond by sending out several other spindly tops and you'd have a bushy mess.

If you can post a picture you'll get a lot more help.
 
Big mistake to cut anything off newly planted tree unless it is a limb that is broken during planting or dead limb. Let the tree start setting roots and get some new growth before starting to train for shape. Even if new tree has obvious defects like co- dominent stems (hopefully not) or crossing branches I would still wait a few growing cycles before starting to train for correct shape. Tree has enough shock from planting to start removing green.
