In this state it only costs $25 to start a claim of up to $600, and a half day off work is cheaper than the rebuild if the guy has time. Just the threat alone can make people change their tune.


Looks like filing in NJ is dirt cheap, and the lowest jurisdictional limit is still $3,000.

Gonna be hard on the business though. Typically, corporate entities MUST be represented by an attorney, and that includes in small claims court, while a natural individual may proceed pro se. I imagine NJ attorneys bill at rates around $250/hour or so.

There is downside risk, the plaintiff may be responsible for the defendants court costs if you loose. Just the threat may make the shop change tune, no pun intended.

Perhaps, but small claims court costs are nominal.


Now, if there was, say, a service contract with a valid an enforceable provision awarding attorney's fees to a party prevailing party, then that would be a different story.
