This tree fell down in my dad's back yard. It is an Oak of some type, I'm just not sure which one. The bark on the upper branches is almost black. My thoughts initially were a black, but now I am thinking a red oak.
When it gets above 0, I am going to get some firewood and maybe try and get some milled.

Not white oak, possibly pin oak but doesn't have the branch structure typical of pin oak. Can you get us a close up of the leaf?
 
Leaves look like a red. Pointy lobes on red, rounded lobes on white. Not sure about pin.
 
Here is a pic of pin oak leaves, very similar to red oak.
